General Terms of Service

All laboratory services and film processing are performed by Baltijas Foto Serviss Ltd at our professional film laboratory located in Riga, Latvia. Please familiarize yourself with our comprehensive service terms to understand our policies and procedures.

General

All laboratory services ("Services") with film and other materials ("Materials") are performed by Baltijas Foto Serviss Ltd at our film laboratory in Riga, Latvia, in accordance with these Baltijas Foto Serviss General Terms of Service ("General Terms").

Important Note

Any terms in the customer's order form, correspondence, or other documents that conflict with these General Terms are null and void unless expressly confirmed in writing by an authorized Baltijas Foto Serviss representative.

Orders must be in written form (including email) and include the necessary instructions for service provision. Orders are considered accepted upon confirmation by Baltijas Foto Serviss.

Price and Payments

The prices in effect on the date of material submission to the Baltijas Foto Serviss laboratory are considered current. The stated prices do not include applicable customs duties, fees, value-added tax for customers outside Latvia, or other taxes that the customer undertakes to pay if applicable.

Payment Terms

Payment for the services must be made according to the invoice or in cash/by card if the customer submits materials in person. Until a mutual agreement is concluded and a credit account is established, all operations with new customers are conducted on a prepayment basis.

Non-payment within the specified term gives Baltijas Foto Serviss the right to cancel services or suspend deliveries without additional notice. The customer agrees to pay interest on overdue payments - 0.1% per day or the maximum rate allowed by law.

Consent and Authorization

The customer guarantees that they have the authority to submit materials to Baltijas Foto Serviss and give instructions to perform services.

The customer also guarantees that they have received consent from all copyright and photographic rights owners for all materials submitted for processing to Baltijas Foto Serviss.

Indemnification

The customer indemnifies Baltijas Foto Serviss against any third-party claims arising from the use, processing, handling, or return of materials.

Packaging Requirements

Materials must be packaged safely and in accordance with industry standards to avoid exposure or material damage.

Required Package Markings

The package must indicate: the customer's name and address, material (film) type, required processing, and all contact information necessary to contact the customer, send scanned materials, and return original materials.

Collection and Delivery

Materials can be collected at the laboratory address - Pulkveža Brieža 3, Riga, LV-1010, Latvia. Unless there is a separate agreement, Baltijas Foto Serviss has no obligation to deliver processed materials to the customer and this is not included in the service price.

Any delivery occurs at the customer's expense and the customer assumes the risk for delivery.

Warranty Disclaimer

All services are provided "as is" without any warranty except as expressly stated in these general terms.

Warranty Disclaimer

All warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement, are expressly disclaimed to the fullest extent permitted by law.

Baltijas Foto Serviss makes no representations or warranties regarding the quality, accuracy, or completeness of any services provided. The customer acknowledges that film processing involves risks and that results may vary depending on the condition and age of the submitted materials.

No Guarantee of Specific Results

Baltijas Foto Serviss does not guarantee specific results, color accuracy, or image quality. All processing is performed using industry-standard methods, but the results depend on the condition of the original material.

Any oral or written information or advice provided by representatives of Baltijas Foto Serviss does not create a warranty or in any way expand the scope of this warranty disclaimer.

Liability Limitations

Baltijas Foto Serviss' total liability for company-caused loss or damage to photographic and imaging materials submitted for services is limited to reimbursement for processing, copying, or printing of these materials and replacement of the material with the same amount of unexposed material.

Transportation Risk

The customer assumes all risk for loss or damage to all materials during transportation to or from the Baltijas Foto Serviss laboratory. The company is not responsible for materials lost or damaged during their transportation.

Except as expressly stated in the Storage Agreement, in no event shall Baltijas Foto Serviss, its managers, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages.

Losses Not Covered by Baltijas Foto Serviss

These include but are not limited to: lost profits, lost revenues, lost savings, data loss, replacement costs, travel losses, or any similar losses arising from services provided by Baltijas Foto Serviss.

The customer has no other rights of claim except those expressly stated in these General Terms, regardless of the basis on which they may be founded.

Insurance Responsibility

If the customer believes their material has or will have any value exceeding the cost of unexposed film, then it is the customer's responsibility to obtain appropriate insurance from an external provider. Baltijas Foto Serviss provides no insurance covering materials submitted to the company.

These liability limitations are in effect even if Baltijas Foto Serviss has been informed of the possibility of such losses. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Prohibited Uses

The customer is prohibited from using our services for the following purposes:

  • Any unlawful purpose
  • Violating local, state, or international laws
  • Violating intellectual property rights
  • Discrimination or harassment
  • Providing false or misleading information

Termination Rights

Baltijas Foto Serviss reserves the right to terminate services if faced with any of the listed prohibited uses of the service.

Complaints and Material Collection

The customer is responsible for inspecting returned materials upon delivery. All complaints must be submitted in writing within thirty (30) days of delivery or in person at the laboratory.

Uncollected Materials

Finished Materials not collected within 60 days will be stored at the customer's expense and risk. 180 days after the submission date, the finished Materials are disposed of.

Law and Jurisdiction

These General Terms are governed by Latvian law, without regard to conflict of law principles. All disputes are resolved at Latvian courts.

Complete Agreement

These General Terms constitute the complete agreement between the customer and Baltijas Foto Serviss, replacing any previous agreements or communications.
